These Terms & Conditions (“Terms”) govern your use of the services provided by Launch Marketing (“we”, “us”, “our”), a UK-based company specialising in real estate photography, videography, and marketing content creation. By placing an order, accessing our website, or using our services, you agree to be bound by these Terms.

1. Definitions

• “Client”, “you”, “your” – The individual, business, estate agent, landlord, developer, or organisation commissioning services from Launch Marketing.

• “Services” – All photography, videography, floorplans, drone media, editing, marketing content, or related services provided by Launch Marketing.

• “Deliverables” – All photographs, videos, digital files, and marketing materials supplied by Launch Marketing.

• “Order” – Any service request submitted via our website, email, or phone.

2. Scope of Services

2.1 Launch Marketing provides:

• Real estate photography and videography

• Drone imagery (subject to CAA compliance)

• Floorplans, 3D tours, and property marketing materials

• Editing and post-production services

• Property marketing content creation

• On-site photography appointments

2.2 All services are carried out with reasonable skill and care.
2.3 Deliverables are supplied digitally unless otherwise agreed.

3. Booking and Ordering

3.1 Bookings may be made through our website, email, or phone.
3.2 You must provide accurate details, including property access instructions, contact information, and service requirements.
3.3 Launch Marketing reserves the right to decline or cancel a booking for safety, legal, or operational reasons.
3.4 For drone services, bookings may be rescheduled if weather conditions or legal restrictions prevent safe operation.

4. Pricing, Payment & Cancellations

4.1 Pricing

• All prices are in GBP (£) and exclusive of VAT unless stated otherwise.

• Quotes are valid for 30 days unless otherwise specified.

4.2 Payment Terms

• Private clients: Payment due in full prior to delivery of final images.

• Business clients: Payment due within 14 days of invoice unless agreed otherwise.

• Late payments may incur statutory interest under the Late Payment of Commercial Debts (Interest) Act 1998.

4.3 Cancellations & Rescheduling

• Cancellations made with more than 24 hours’ notice incur no charge.

• Cancellations within 24 hours may be subject to a cancellation fee of up to 50% of the booking value.

• If the photographer arrives on-site and is unable to access the property, a call-out fee may apply.

5. Property Access & Client Responsibilities

5.1 The Client is responsible for ensuring the property is ready for photography, including:

• Clean and tidy rooms

• Access to all required areas

• Removal of personal or sensitive items

• Ensuring pets are restrained or removed if necessary

5.2 Photographers cannot move heavy furniture, valuables, or hazardous items.
5.3 If the property is not suitably prepared, Launch Marketing may proceed as-is or reschedule at an additional fee.

6. Delivery of Images and Content

6.1 Standard turnaround for photography is typically 24–72 hours, but this may vary depending on workload and service type.
6.2 Deliverables are supplied via digital download unless otherwise arranged.
6.3 Minor edits are included; extensive retouching or additional editing may incur additional fees.
6.4 Deliverables remain available for download for a minimum of 30 days.

7. Copyright & Usage Rights

7.1 Launch Marketing retains full copyright to all images, videos, and digital content produced, as protected under the Copyright, Designs and Patents Act 1988.

7.2 Client Licence

Upon full payment, the Client receives a royalty-free, non-exclusive licence to use the Deliverables for:

• Property listing and marketing

• Estate agency promotion

• Social media marketing

• Printed or online advertising of the property

7.3 Restrictions

Clients must not:

• Sell, transfer, or give rights to third parties (e.g., builders, interior designers, vendors) without permission

• Use images for unrelated marketing or commercial purposes without written consent

• Sub-license, edit, or alter images in a misleading or defamatory way

7.4 Launch Marketing may use images for portfolio, website, social media, and marketing unless the Client requests otherwise in writing.

8. Image Integrity & Accuracy

8.1 While we strive to represent properties accurately, photography may include:

• Wide-angle lenses

• Exposure blending

• Colour correction

• Sky replacements

These are used to enhance presentation and are not intended to mislead.

8.2 It is the Client’s responsibility to ensure marketing images are used in a fair and legal manner.

9. Drone Services (If Applicable)

9.1 All drone operations are subject to weather conditions and Civil Aviation Authority (CAA) regulations.
9.2 Flights cannot proceed if unsafe or legally restricted.
9.3 The Client must ensure that the property and surrounding area can be safely filmed.

10. Liability

10.1 Nothing in these Terms limits liability for:

• Death or personal injury caused by negligence

• Fraud or fraudulent misrepresentation

10.2 To the fullest extent permitted by law, Launch Marketing is not liable for:

• Loss of profits or business opportunities

• Property access delays

• Weather-related postponements

• Incorrect information supplied by the Client

• Issues arising from third-party platforms or listing services

10.3 The maximum liability of Launch Marketing shall not exceed the total amount paid for the specific service.

11. Data Protection & Privacy

11.1 Launch Marketing processes personal data in accordance with the UK GDPR and Data Protection Act 2018.
11.2 We may store contact details, booking information, and images as required to deliver our services.

12. Termination

We may terminate an order if:

• Payment is not made according to agreed terms

• The Client behaves abusively or unreasonably

• The Client breaches these Terms

The Client is responsible for payment of all completed work up to the termination date.

13. Governing Law

These Terms are governed by the laws of England and Wales.
Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

14. Amendments

Launch Marketing may update these Terms periodically.
